The question brought before the court in this case calls in its resolution for a refinement of the rule relating to the shifting of the burden of proof from an employee to an employer under the "odd-lot doctrine" in a workers compensation case. The district court held that the employee had failed to sustain his burden of proof in this instance. In effect this was a holding that the burden of proof was not shifted to the employer. We are in accord with this ruling by the district court, and we shall affirm the judgment.
